Basically there is going to be some new European legislation coming in May that states "explicit consent" must be gathered from web users who are being tracked via text files called "cookies".

We are getting questions from clients about this and have no idea if DNN will be providing a solution or how it will be affected .

Any information would be very much appreciated.

we're aware of the directive and will be discussing the required course of action in the security team. I'm reading the directive currently to determine exactly what areas and forms of consent are required, as theres a lot of conflicting articles stating different requirements e.g. some state all cookies (which would mean all websites as session cookies are automatically created, and most sites use forms auth cookies), others only state tracking cookies - but the definition of tracking cookie is not solid.

Whilst most people regard companies such as doubleclick as tracking, some don't regard analytics via google as tracking - though in many ways google uses the same data and does change it's advertising based on knowledge gleaned from cookies. If google cookies are required to have consent it could mean that any new visitor to a website would see a popup and have to agree to it before accessing the site, which would certainly be disruptive. It's also not clear if the directive is based on hosting location e.g. a site hosting in the US for an EU company would not require consent, but a US company hosted in the EU would (in addition cloud based websites such as MS Azure powered one where content is distributed globally is another point that needs clarification).

Interesting read, another example of a putting companies doing business at a competitive disadvantage to the rest of the world.

The European legislation cannot dictate their laws to any country outside of their jurisdiction.
This mean if a site is hosted in any country outside their jurisdiction there is nothing they can do outside of blocking access.

Now that doesn’t mean they cannot penalize or even shutdown companies that decided to host in another country to avoid the stricter laws.

As for companies with a global footprint they will need to determine if this in the best interest of their company to continue doing business in countries affected by these laws.

Case in point, Google vs China, what will be more important company revenues or principals.

Hi Cathal

Has anything been implemented on the EU cookie law coming into play on 28 May 2012 or perhaps some direction as far as DNN installations are concerned?

I cannot see any further information on the site re this.
