When accessing this site (DotNetNuke.com)  with IE8 and hover over the menu all submenues opens but they dont close. I asume this behavior is not by design.

I have not seen this behavior on my sites. Maybe its just the PE version I dont know. Anyhow I think a support ticket shoud be sent to Corp. As IE 8 released I asume DNN should be tested for IE 8.

Maybe it just my version of IE 8 I dont know. If someone needs my assistant to further investigate just tell me.

I experience the same. IMHO this has the great advantage to easily get an overview over all menu items of the site :)

By the way error in line 249 in dnn.dom.positioning.js ....

I was just testing my own sites with IE8 and ran into your post. It looks like IE8 and dnnNAV on 04.09.02 exhibit these symptoms. 05.00.01 works OK. I checked both with plain vanilla installs without modifications (using all defaults).
