It appear that the DOCTYPE tag for the default.aspx page is always defaulted to

<!DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 4.0 Transitional//EN">
I am trying to get parts of my custom skin to work properly is there a way to set the DOCTYPE to 

<!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Strict//EN">

instead?  Will anything in DNN break by changing this?

It appears this information is set in the asp:literal id="skinDocType" runat="server"></asp:literal> tag is anyone sure what feeds this tag?

you can override it via an optional file http://www.dotnetnuke.com/Community/Blogs/tabid/825/EntryID/1226/Default.aspx, some people also use http://blogs.snapsis.com/PermaLink,guid,739278ef-6d9e-4e73-804b-45627dcc6256.aspx .

Note: in dnn 5 doctype will be able to be set via a host setting.

Thanks.  The first method works great.  In DNN5 doctype will be stored in the database?  Will it be able to be set at the page level / skin level / site / porta level?

no, doctype will not be set in the database. In dnn5 there is a host level setting for default doctype & this can be overriden by individual doctype.config files at the skin level. The value is persisted as part of the tabinfo object so you can change it by changing the activetab.doctype property
