You can modify the terms page text via the localization files.  I believe they are either in the sharedresources or globalresources files.

All portal owners are encouraged to adopt terms of use and privacy statement to meet the situation of the indiviual web site.

To adopt both for your portal, go to languages in ADMIN menu, enter the language editor and you get displayed GlobalResources.resx by default. Select your language and scroll down to "MSG_Terms.text". You can use the upright arrow to enter the richtext editor, same for "MSG_Privacy.Text". Those changes will be preserved during portal or language pack upgrades.
