I uninstalled the previous version. I installed the new module. on 5.05.01 running .net 4. The uninstall and install reported success and no errors.
I installed the module on a test page and got an error  and I found this in the event log:

Are you certain that you installed the 04.03.03 Release candidate (http://dnngallery.codeplex.com/releas...) and not the 04.03.00 official release (from 2009) which does have this as a know issue when running on 5.05.01 and/or ASP.Net 4.0?

you were correct in that i had the earlier version installed. I uninstalled and reinstalled the newer module and still have the same error.
