Ok so i figured out what was going on with this upgrade.

The version thing was caused by the fact that I wasnt able to restore the live database onto my test envirmoent because the live enviroment is mssql 2005 and the test enviro is 2000 (came up with error regarding to many backup devices, which is apparently fixable by installing the latest sp for mssql 2000). So i ended up using the export wizard which didnt copy over the primary keys, auto_increments and so on, The site worked fine but when upgrading it fell over. Also note that i couldnt generate a script of the db either because of permissions, site is hosted with someone esle.
The sql error was caused by the test enviroments tempdb was a different collation to the dotnetnuke one.......one was sql_latin and the other just latin.

In the end i just used sqlexpress2005 and managed to upgrade one of the site, so onto the next!
