This seems to be a problem with the users. 

If (try to) put myself in the spammers shoes for a moment then surely I do not care how new/old the thread is.  in fact I have some difficulty seeing the advantage to the spammer of hitting on an old thread.  Why don't I spam one that's right there in front of me rather than scrolling down a few pages to find an old one.  If you lock the old threads - I'll spam some new ones instead.

Seems to me that you should just kick out users that spam.

Yes, this is a good observation - it is a reaction to a problem. The way I see it is that it is one more weapon or tool against spammers though, and makes the Forum Moderators task slightly easier. I suppose it depends on the nature of your data and if it ages or not. It's one of the features of VBBulletin (I think thats the name of it) and is implemented on some massive Forum communities like SitePoint.
