Hello,

This is now a dead topic - my concern with Old Turtle has been resolved.

The new Help Desk 2 version has a lot of great features that I have been waiting for.  However, the initial release of version 2 had moved to a subscription model.  I had bought a perpetual license and was now told that I had to "upgrade" to a subscirption product.

I am now happy to report that Old Turtle has now reconsidered and will continue to offer perpetual licenses, at least to existing clients.

I recently purchased Old Turtle Help Desk 1 which comes with a perpetual license.  Before purchase I asked about POP3 support and several other shortcomings in their product that I discovered with their demo version.  They promised "POP3 available with the new upgrade".  The other concerns I had were also going to be fixed "in the next upgrade".  I then bought the product with the assumption it was going to be updated over time and I would benift from an improving product.
 
The "new upgrade" is now out.  The problem was that Help Desk 2 uses a subscription model.  I contacted Old Turtle support and asked if they would be adding any of of the promised features to the perpetual license product that I had purchased.  OldTurtle has told me "no", and it contends that Help Desk 2 is an "upgrade" to Help Desk 1 and that if I want any of the promised features, then I need to move to their subscription product.  

They do offer 12 months of "free" upgrade to their subscription product (worth $180!) but I want the promised upgrades to my perpetual license (I paid $229).
 
What do other people think?  Was this deceptive?  Was I mislead?  Should I be entitled to a refund?

A perpetual license is a bit of an odd feature, because I can't imagine any product not having one. All it means is that you can use it forever.

However I would have to admit that a perpetual license has nothing to do with perpetual upgrades. It's like buying Windows, you can use it forever, but you only get upgrades for the official support lifetime of the product.

I believe you should get security and serious bug patches within the support lifetime of any product, and regardless of any subscription, but feature updates are different.

Basically licenses and product releases are different things and if you didn't get a subscription for the latter then you're stuck. I'd tell the guy you misunderstood this, and could he come to an arrangement with you to change to a subscription. If he has any sense of customer service, he'll do you a good deal.
