I solved the problem by adding a z-index to the .submenu-wrap class in my skin file - (this could probably do with doing higher up in the portal or menu files, because the problem will reoccur on a skin change, but the problem is fixed for now.)

also the z-index had to be at least 1000 for the fix to work.

 i was a bit to soon it worked for the menu on my site but now my submenus from the admin panels do not show.

when i am in the following url al is fine
http://www.wvdbroek.com/en-us/home.aspx

but in my native language

http://www.wvdbroek.com/nl-nl/home.aspx or in http://www.wvdbroek.com/default.aspx
the admin menus do not work
strange.
